“Klintensiv Rewards You”

  1. CONTEST NAME AND ORGANIZER

Art. 1. The name of the Contest is: “ Klintensiv Rewards You” (hereinafter also referred to as the “Contest”).

Art. 2. The Organizer of the Contest is Societatea Klintensiv S.R.L, with its registered office in the town of Bragadiru, sos. Alexandriei no. 544, km. 14, Administrative Pavilion, ground floor, office no. 4, Ilfov county, registered with the Trade Register Office under no. J23/3025/2011, Tax ID RO 29359178, e-mail office@klintensiv.com, bank account no. RO15INGB0000999906241718, opened at ING Bank N.V Amsterdam, represented by Mr. Cristian STANCIU – General Manager.

  1. CONTEST RULES

Art. 3. The Contest shall be conducted in accordance with these Rules. Rules mean this document, including as it may be amended, including any and all rules of the Contest, which are unconditionally binding for all Participants.

Art. 4. The Rules will be brought to the public’s attention on the Organizer's website (www.klintensiv.ro), the Organizer's Facebook page (https://www.facebook.com/klintensiv and at klintensiv.ro), as well as through any other means imposed in accordance with the applicable legislation in Romania.

III. CONDITIONS FOR PARTICIPATION IN THE CONTEST

Art. 5. Any person who cumulatively meets the following conditions (collectively referred to in these rules as “Participants” and each of them as “Participant”) may participate in the Contest:

  1. have reached the age of 18 by the date of registration for the contest at the latest;
  2. have their domicile or residence on the territory of Romania;
  3. are natural persons, Romanian citizens;
  4. comply with the contest requirements.

Art. 6. The following may not participate in this Campaign:

  1. employees and natural person collaborators (having an active contract) of the Organizer;
  2. Members of the families of the employees mentioned in the points above (children, parents, brothers, sisters, husband, wife).

Art. 7. In the event that persons who have influenced or facilitated the winning of a prize are identified, the Organizer has the right to request the return of the prize won in such a manner.

Art. 8. Participants must cumulatively fulfill all obligations imposed upon them by these Rules.

Art. 9. Data sent by participants that has obscene, defamatory, threatening, pornographic, harassing content or that violates any law will not be taken into account, and participants will be disqualified from the campaign or may even have their access to the page restricted.

Art. 10. Registration and participation in the contest are free of charge.

  1. PERSONAL DATA PROTECTION AND PRIVACY RULES

Art. 11. In the context of organizing and conducting this Campaign, the Organizer processes personal data in accordance with the legislation in the field of personal data protection, namely Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (“GDPR”), as a processor of the End Client.

Art. 12. (1) The Organizer will process the registration data of the Campaign participants, such as: name, surname, date of birth, and image data.

(2) In the case of participants designated as winners, the Organizer will process the following data: home address for prize delivery, phone number, email address, or any other information that will be requested by tax authorities for the purpose of fulfilling legal obligations regarding the payment of taxes related to the prizes.

Art. 13. Personal data is processed for the following purposes:

  1. Organizing and conducting the Campaign, including awarding prizes to winners;
  2. Payment of taxes and contributions related to the awarded prizes, reporting to competent public authorities, publishing the names of the winners and the prizes, communicating professional information, news, and offers;
  3. Resolving any complaints related to the way the Campaign is organized and conducted, investigating potential violations, carrying out specific reporting, analyses and statistical studies, defending the Organizer's rights in court and/or other judicial or administrative proceedings;
  4. Fulfilling legal obligations, such as, but not limited to, obligations related to archiving, security, keeping accounting or tax records.

Art. 14. The legal bases for processing the personal data of Campaign participants are as follows:

  1. their consent;
  2. the legitimate interest of the Organizer;
  3. fulfillment of legal obligations.

Art. 15. The personal data of participants will be processed for the entire duration of the Campaign. They are kept as long as necessary for the fulfillment of the purposes for which they were collected, in compliance with internal procedures regarding data retention, including applicable archiving rules. Regarding data necessary for financial-accounting purposes, these will be stored for a period of 3 years from the closing of the financial year during which they were collected.

Art. 16. The Organizer may disclose the personal data of participants to the following categories of recipients:

  1. Partners involved in the conduct and organization of the Campaign, including awarding the prizes;
  2. Accountants, auditors, public notaries, or professional consultants appointed to provide assistance for the organization and conduct of the Campaign, who will be obliged by law or by the contract concluded with the Organizer to maintain the confidentiality of the personal data to which they have access;
  3. Courier service providers;
  4. Public authorities from any field, central or local, both in Romania and abroad, which will process personal data at their request or at the initiative of the Organizer, in accordance with applicable law;
  5. The competent court in Romania, in the event of a dispute, to the extent necessary for the establishment, exercise, or defense of a right of the Organizer.

Art. 17. Personal data will be processed on the territory of the European Union and will not be transferred to other companies, organizations, or persons in third countries or to international organizations.

Art. 18. Regarding the security of personal data, appropriate technical and organizational measures have been implemented to protect the collected and processed personal data, such as: staff training, limiting access to personal data so that it is processed only by employees or collaborators who need access to the information in order to fulfill legal or contractual obligations, etc.

Art. 19. In accordance with the provisions of Regulation 679/2016, participants benefit from the following rights, as data subjects:

  1. The right of access to the personal data processed by the Organizer, including the right to obtain information regarding the nature, processing, and disclosure of this data;
  2. The right to rectify inaccuracies in personal data processed by the Organizer;
  3. The right to erasure of data processed by the Organizer (“right to be forgotten”);
  4. The right to restrict the processing of personal data processed by the Organizer;
  5. The right to object to the processing of personal data;
  6. The right to personal data portability;
  7. The right to withdraw consent, in situations where data processing was carried out based on consent. This request can be made at any time, and the withdrawal of consent will not affect the legality of the personal data processing carried out before the withdrawal.

Art. 20. To exercise the rights mentioned above, data subjects may send a request to the following e-mail address: office@klintensiv.com.

  1. CAMPAIGN CONDUCT AND DESIGNATION OF WINNERS

Art. 21. The Campaign takes place on the territory of Romania, on the Organizer's website www.klintensiv.ro (Contests section), from 01.04.2025, 10:00 AM – 01.12.2025, 11:59 PM.

Art. 22. From 01.04.2025 until 01.12.2025, participants register for the contest by completing the physical or online form on the official contest page.

Art. 23. For valid registration, in order to participate in the Contest, the following conditions must be met cumulatively:

  1. Registration must be done exclusively during the contest period, between 01.04.2025 – 01.12.2025.
  2. Participants must have the right to participate according to the provisions of Art. 5.

Art. 24. Within the “Klintensiv Rewards You” Campaign, a total of 12 prizes are awarded. Each prize contains:

VII. DESIGNATION OF WINNERS

Art. 25. In this contest, 2 draws will be conducted via raffle, resulting in the designation of 12 winners as well as 12 reserves. The draws will take place on 02.12.2025, using the platform https://www.random.org/

Art. 26. Prizes will be shipped to the drawn and validated persons exclusively within the territory of Romania.

VIII. VALIDATION AND PUBLICATION OF WINNERS

Art. 27. The organizers are obliged to make public the names of the winners as well as the awarded prizes within a maximum of 5 working days from the moment of designating the winners. The organizers will publish the names of the winners and the prizes won on the page https://www.facebook.com/klintensiv si klintensiv.ro

Art. 28. For a participant to be validated as a winner of the contest, it is necessary to meet all the conditions established by these Rules, as well as the Participant's obligation to transmit the requested data within 72 hours from the moment of the announcement of the winners by the Organizer.

Art. 29. During the validation process, the winner must provide the Organizer with the following data: name and surname, complete shipping address for the prize, and a phone number for the purpose of verifying compliance with participation conditions and delivering the prize.

Art. 30. In the event that a potential winner does not respond to the Organizers' request, i.e., does not send the requested data for validation within 72 hours of being contacted, they will be invalidated and will lose any right to the prize, and the Organizers will resort to the reserve winner. The validation conditions for the reserve are the same as for the winners.

IX. WINNER VALIDATION AND PRIZE AWARDING

Art. 31. A maximum of 12 prizes will be awarded in the contest. Each participant can win a maximum of one prize.

Art. 32. The Organizer will make the contest prizes available and will ship the prizes to the published winners within a maximum of 30 (thirty) working days from the date of publishing the winners, via courier, to the address indicated by them.

Art. 33. Any error and/or omission regarding the personal data provided to the Organizers does not attract their liability, the accuracy of the contact data provided by participants being their sole responsibility. The Organizers are not responsible even in the case where a Participant designated as a winner cannot be contacted due to an incorrect/incomplete name, address, or phone number.

Art. 34. Persons drawn and validated as winners in this campaign DO NOT have the possibility to receive the cash equivalent of the prizes or to exchange them for other goods, nor to request a change in the parameters/characteristics of the prizes or to assign them to other persons; if they wish to waive the prize, the Organizer will dispose of the prize according to its own interests.

Art. 35. During the campaign, each participant has the right to win only one prize, and this rule also applies to persons who have the same address and/or are members of the same family.

Art. 36. The Organizer and the Processor reserve the right to modify the Contest Prizes, but to offer similar prizes of similar values if the modification is necessary.

Art. 37. The total estimated value of the prizes awarded in this campaign is 8096 lei, to which the cost for courier shipping is added.

Art. 38. The individual prizes offered in this campaign exceed the sum of 600 RON/piece. These are subject to income tax.

Art. 39. In the event that, for any reason, the Prize cannot be awarded to any of the initially designated Winners, the Organizer may designate, if it considers it necessary, another winner in accordance with these Rules.

Art. 40. The winners will be notified of winning the Prizes via the Facebook platform by the Organizer. Winners must follow the procedure indicated by the Processor for the awarding and handing over of the Prizes.

Art. 41. The Organizer may make public the names, surnames, and awarded prizes on the Contest communication channels. Without affecting the generality of the above, the names and surnames may be made public by publication on the Organizer's Facebook account.

X. TAXES AND DUTIES

Art. 43. Any tax-related obligation in connection with the won prize is the sole responsibility of the Organizer.

Art. 44. The tax related to the prizes will be borne entirely by the Organizer.

Art. 45. No additional indirect expenses are imposed on contest participants, except for normal participation expenses (expenses related to Internet access in order to register for the Contest or consult the Rules of conduct).

Art. 46. Any other obligations of the winner related to the use of the won prize are solely the responsibility of the winner.

XI. ANTI-CORRUPTION CLAUSE

Art. 47. Compliance with Applicable Legislation regarding bribery and corruption is of fundamental importance to the Organizer. Consequently, each Party, including their employees, agents, consultants, contractors, and subcontractors:

  1. will act in accordance with the applicable legislation regarding bribery and corruption;
  2. do not omit and will not omit any action that could cause the other Party to violate any of the provisions regarding bribery and corruption;
  3. shall not offer, promise, receive, or solicit any bribe (financial or other benefits) including, without limitation, in relation to a public official;
  4. shall maintain appropriate and effective anti-bribery measures (including regarding gifts and hospitality), aimed at ensuring compliance with bribery and corruption provisions, including monitoring compliance and detecting violations;
  5. any reasonable suspicion regarding the violation of the provisions of this clause regarding bribery and corruption may be reported at any time to the address: office@klintensiv.com

XII. RESPONSIBILITY AND LIMITATION OF LIABILITY

Art. 48. The Organizer is entitled to take all necessary measures in case of attempts to defraud the Contest mechanism, abuse, or any other fraudulent attempts that could affect the image of the companies involved.

Art. 49. The Organizer is not responsible for any changes to the Facebook platform. Thus, if during the contest, changes to Facebook's policy occur that lead to the possibility of this contest being deleted by Facebook or unable to be continued, the Organizer has no responsibility to compensate the participants.

Art. 50. The Contest may be interrupted by the Organizer at any time during its duration in case of a force majeure situation or a change in the Contest Regulations.

Art. 51. Any complaints will be taken into consideration within a maximum of 5 (five) business days from the date of the public announcement of the winners. Any complaints received after this date will not be taken into consideration.

Art. 52. In the event of a dispute over the validity of an entry in the campaign, the decision of the committee formed by a representative of the Organizer is final.

Art. 53. The Organizers do not assume responsibility for:

  1. Registration on web pages other than klintensiv.ro, Contests section.
  2. Entries sent outside the contest periods as provided in these Regulations;
  3. Errors in the data provided by the winners or the lack of accuracy of contact details do not entail the liability of the Organizers, being the exclusive responsibility of the participants. As such, they have no obligation in the event that participants provide erroneous, incomplete, or incorrect data that led to the impossibility of sending the prize under normal conditions or the impossibility of identifying a winner;
  4. The Organizers will not be responsible for a winner's inability to take possession of the won prize;
  5. The Organizers will not be responsible for delays in the delivery/handing over of prizes caused by delays in the provision of services by its suppliers, namely courier/postal services;
  6. Complaints regarding the won prize after the moment of signing the prize handover document will not be taken into consideration by the Organizers;
  7. Errors caused by the incorrect use of the personal computer by the participant (interruption of the computer's power source, errors given by the operating system installed on the computer, errors caused by viruses in the computer's operating system, errors caused by the malicious use of technology by the participant for the purpose of manipulating the contest results);

Art. 54. Situations in which certain persons registered in the contest are unable to participate partially or fully in the Contest, if this incapacity is due to circumstances beyond the control that the Organizers can reasonably exercise.

XIII. DECLARATIONS AND WARRANTIES

Art. 55. By registering for the Contest, each Participant irrevocably, expressly, unequivocally, and unconditionally undertakes to fully and properly comply with the Regulations.

Art. 56. Without affecting the generality of the above, by registering for the Contest, each Participant irrevocably, expressly, unequivocally, and unconditionally confirms that:

  1. they have read and understood the Regulations, agree with the Regulations, and accept to fully comply with its terms and conditions;
  2. they have understood and agree that, in case any Participant does not fully and properly comply with any of the terms and conditions of these Regulations, the respective Participant may be excluded from the Contest and/or the respective Participant may no longer be designated as a Winner and/or the Organizer and/or the Representative have the right to no longer award the Prize to the respective Winner.

Art. 57. (1) By registering for the Contest, each Participant irrevocably, expressly, unequivocally, and unconditionally agrees that if they are designated as a Winner, the performance carried out on the occasion of participating in the Contest, their designation, and/or the awarding of the Prizes may be recorded by the Organizer on audio, photo, audiovisual, and/or any other type of medium, the materials thus obtained to be used by the Organizer according to its needs.

(2) Thus, by registering for the Contest, each Participant irrevocably, expressly, unequivocally, and unconditionally agrees to the fact that, if they are designated as a Winner, their name and surname and/or their image and/or their voice and/or any of their performances on the occasion of the designation and/or awarding of the prizes and/or any recording of them and/or any materials may be made public and/or used by the Organizer/Representative according to its own needs, without any payment or other additional obligations on the part of the Organizer/Representative.

XIV. DISPUTES AND APPLICABLE LAW

Art. 58. Any dispute between the Organizer and/or the Representative and any of the Participants and the Winner will be settled amicably; otherwise, disputes will be settled by the competent Romanian courts in the Municipality of Bucharest, excluding the possibility of reference to conflict of laws.

Art. 59. The Regulations will be interpreted and governed by Romanian law, which is the applicable law in case of any dispute that may arise in connection with this Contract, excluding the possibility of reference to conflict of laws.

Art. 60. Any complaints related to the conduct of the Campaign can be sent to the Organizers' address within a maximum of 3 (three) business days from the date of the public announcement of the winners. After the expiry of this term, the Organizers will no longer consider any complaint.

XV. FORCE MAJEURE

Art. 61. Force majeure exonerates the party invoking it from liability, according to the provisions of the Civil Code (art. 1351 NCC). Force majeure is any external, unforeseeable, absolutely invincible, and inevitable event, and a fortuitous case is an event that cannot be foreseen or prevented by the one who would have been called to answer if the event had not occurred.

Art. 62. The Contest may end ahead of schedule, both in the case of an event constituting force majeure, as regulated by the current Romanian legislation, including in the case of the Organizer's inability, for reasons independent of their will, to continue this contest, as well as if the Organizers wish to do so. In these situations, the Organizers are not bound to return/reimburse or pay any amount as compensation/damages or similar.

XVII. UPDATING AND MODIFICATION

Art. 64. The Organizer reserves the right to modify the Campaign Regulations, with such changes coming into force only after they have been previously published on www.klintensiv.ro, Contests section, and announced on the Facebook page https://www.facebook.com/klintensiv/.

Art. 65. According to the free decision of the Organizers, the Campaign may be publicized for the purpose of informing the public, including through advertising and/or informative materials.

Art. 66. The provisions of these Regulations are drawn up in accordance with the provisions of Government Ordinance no. 99/2000 regarding the marketing of products and market services and are mandatory for all participants.

Art. 67. The Organizers reserve the right to modify these regulations/contest conditions/contest draw date, these changes being brought to the public's attention by posting on its Facebook page.

XVIII. FINAL CLAUSES

Art. 68. This Campaign aims to promote Klintensiv products and brand to its customers and potential customers. In this sense, this campaign represents a popularization tool for the purpose of retaining existing customers and attracting new ones.

Art. 69. By participating in this Campaign, participants agree to the provisions of these Regulations.

Art. 70. The provisions of these Regulations are supplemented by the provisions of the applicable legislation in force and by the terms and conditions of the direct suppliers of the services that form the prizes. The Organizer reserves the right to modify these Regulations whenever necessary, with appropriate information to those interested.
